Expulsions

Foreigners without a proper entry visa or permit to stay in the country will be expelled or accompanied to the border:

  • foreigners who have entered Italy without a proper entry visa are illegal immigrants;
  • foreigners who have lost the requisites necessary to stay in the country (e.g., failure to renew their permit to stay in the country upon expiry), which they possessed upon arrival in Italy, are irregular.

In accordance with the laws in force, illegal immigrants must be turned away at the border or expelled.

They cannot be expelled immediately if:

  • they need aid;
  • it is necessary to check their identity or nationality;
  • travel documents must be prepared;
  • no suitable means of transport is available;
  • they must be accommodated, following provision by the chief of police (questore) validated by the magistrate, in appropriate temporary accommodation and assistance centres (art.14 of Consolidated Act no. 286/98) for the time strictly necessary for their identification and expulsion.

The Ministry of the Interior adopts the provisions necessary for the implementation of the expulsion (also via agreements with other government administrations, local authorities, owners or licensees of areas, structures and other installations) and for the performance of assistance.
