The short stay-new regulation procedures

The Minister for the Interior Amato has signed the ministerial decree containing the new short stay regulation procedures introduced in Law no. 68 of 28 May 2007, which came into force on 2 June last.

The Law, applying a European Union obligation, has abolished stay permits for foreigners staying in the country for less than three months for visits, business, tourism or studies.

Stay permits have been replaced, with no change to the entry visa requirement, by:

  • a declaration of presence to be issued to frontier police when the person enters Italy, if the foreigner is coming from Countries that do not apply the Schengen treaty;

  • or, for those coming from Schengen treaty Countries, a declaration of presence to be issued to Police Authorities in the Province the person is staying in, within eight days of entering the country.

To make it easier to comply for those affected by these new regulations, local Police authorities will have 'presence declaration' forms available containing the necessary data:

  • personal,

  • passport,

  • entry visa and

  • reason for stay details.
