CONSULTAZIONI REFERENDARIE GIUGNO 2003

Legge 459 del 27 dicembre 2001 recante " Norme per l'esercizio
del diritto di voto dei cittadini italiani residenti all'estero"

1. Per cosa si vota?
a. Il prossimo 15 giugno si voterà per due referendum popolari abrogativi.
b. Il primo riguarda la reintegrazione dei lavoratori illegittimamente licenziati - Abrogazione delle norme che stabiliscono limiti numerici ed esenzioni per l'applicazione dell'art. 18 dello Statuto dei lavoratori
c. Il secondo riguarda l'abrogazione della servitù coattiva di elettrodotto (eliminazione dell'obbligo per il proprietario di un terreno di far passare sul suo fondo un elettrodotto).

2. Chi vota?
a. Per la prima volta potranno votare per corrispondenza tutti i cittadini italiani residenti all'estero iscritti nelle liste elettorali.
b.
3. Come si vota?
a. Il voto dei cittadini italiani residenti all'estero viene espresso per corrispondenza, secondo quanto previsto dall'art. 1, comma 2, della Legge 459/2001.
b. Entro il 28 maggio prossimo ciascuno elettore, che non abbia esercitato l'opzione per votare in Italia, riceverà dal proprio Ufficio consolare un plico contenente :
- il certificato elettorale (cioè il documento che certifica il diritto di voto)
- due schede di votazione di colore diverso per ognuno dei due referendum :

- due buste di formato diverso.
c. L'elettore esprime il proprio voto tracciando un segno sul rettangolo della scheda che contiene la risposta prescelta (SI o NO) utilizzando ESCLUSIVAMENTE una penna che scriva con colore nero o blu.
d. Entrambe le schede vanno inserite nella busta completamente bianca più piccola che dovrà essere chiusa e sigillata. Questa busta sigillata e il tagliando del certificato elettorale (che deve essere staccato dal certificato utilizzando l'apposita linea tratteggiata) devono essere inseriti nella busta più grande preaffrancata, riportante l'indirizzo dell'Ufficio consolare competente.
e. Si raccomanda di non apporre né sulle schede né sulla busta sigillata né sul tagliando alcun segno di riconoscimento, pena la nullità del voto. Sia la busta sigillata che le schede devono essere integre. SULLA BUSTA PREAFFRANCATA DA RESTITUIRE ALL'UFFICIO CONSOLARE NON VA RIPORTATO IL MITTENTE. Tale busta deve essere restituita per posta all'Ufficio consolare al più presto possibile e comunque non oltre il 5 giugno prossimo (decimo giorno antecedente la votazione).
f. Gli elettori che, quattordici giorni prima della data delle votazioni (cioè a decorrere dal 1° giugno), non abbiano ancora ricevuto al proprio domicilio il plico elettorale possono farne richiesta presentandosi personalmente al proprio Ufficio consolare e ritirando un duplicato del plico elettorale. L'elettore è tenuto a restituire quanto prima per posta all'Ufficio consolare la busta preaffrancata contenente le schede entro il termine fissato (cioè non oltre il 5 giugno).
(ALTERNATIVA : i connazionali che non ricevono al proprio domicilio il plico elettorale possono verificare presso il proprio Ufficio consolare la loro posizione ai fini dell'esercizio del diritto di voto ).

JUNE 2003 VOTE ON REFERENDA

Law 459 of 27 December 2001 providing "Standards on Voting for Italian Citizens Residing Abroad"

1. What is being voted on?
a. on June 15 a vote will be held on two referenda for repeal
b. the fist concerns the rehire of workers illegitimately fired "Repeal of norms establishing numeric limits and exemptions for the application of Article 18 of the Labor Code"
c. the second concerns the repeal of compulsory servitude for electrical lines (eliminating the requirement that land owners allow the placement of electrical lines along the bottoms of their property).
2. Who is eligible to vote?
a. for the first time, all Italian citizens residing abroad who are registered voters may vote by mail (absentee ballot).
3. How do you vote?
a. Italian citizens residing abroad will vote by mail pursuant to Article 1, Paragraph 2 of Law 459/2001.
b. By 28 May 2003 all voters who have not opted to vote in Italy will receive from their respective Consular Offices an envelope containing:
· the vote certificate (document certifying eligibility to vote)
· two different colored ballots, each corresponding to one of the two referenda:
· I BLUE BALLOT FORM "REHIRE OF ILLEGITTIMATELY FIRED WORKERS. REPEAL OF NORMS ESTABLISHING NUMERIC LIMITS AND EXEMPTIONS FOR THE APPLICATION OF ARTICLE 18 OF THE LABOR CODE"
· II ORANGE BALLOT FORM "COMPULSORY SERVITUDE FOR ELECTRICAL LINES. REPEAL"
· Two different size envelopes
c. Voters make their selections by marking one of the boxes on the forms next to the prewritten selection (YES or NO), using a blue or black color pen ONLY.
d. Both forms are inserted into the smaller, all-white envelope; the envelope is then sealed. The sealed envelope and the tear-away slip from the voting certificate (detached from the certificate along the marked lines) are then inserted into the larger, pre-stamped envelope bearing the address of the designated consular office.
e. The ballots, envelopes and tear-away slips must be free of any identifiable marks, otherwise the vote will be nullified. Both the sealed envelope and the ballots must be intact (no staples, clips, etc.). DO NOT INDICATE THE SENDER ON THE PRE-STAMPED ENVELOPE RETURNED TO THE CONSULAR OFFICE. The envelope must be promptly returned by mail and be received at the consular office by no later than 5 June (ten days prior to the voting date).
f. Anyone who fourteen days prior to the voting date (i.e., as of 1 June) has not yet received the voter package at their registered domicile may come personally to the consular office to request a duplicate package. Voters are required to return the pre-stamped envelope containing the forms promptly by mail to the consular office so that they arrive by the prescribed date (no later than 5 June).

REFERENDUM JUIN 2003

Loi 459 du 27 décembre 2001 fixant les " Dispositions pour l'exercice du droit de vote des citoyens italiens résidant à l'étranger"

1. Objet du vote
a. Le 15 juin prochain les électeurs seront appelés à voter pour deux référendums populaires d'abrogation.
b. Le premier concerne la réintégration des travailleurs victimes d'un licenciement illicite. Abrogation des dispositions fixant les seuils numériques et l'exemption de l'application de l'art. 18 du statut des travailleurs.
c. Le deuxième concerne l'abrogation de la servitude légale de câbles électriques (élimination de l'obligation pour le propriétaire d'un terrain de faire passer un câble électrique sur sa propriété).
2. Les votants
a. Pour la première fois, tous les citoyens italiens résidant à l'étranger et inscrits sur les listes électorales pourront voter par correspondance.
3. Procédure de vote
a. Le suffrage des citoyens italiens résidant à l'étranger sera exprimé par correspondance, aux termes de l'art.1, alinéa 2, de la Loi 459/2001.
b. Avant le 28 mai prochain les électeurs qui n'auront pas exercé l'option de vote en Italie recevront de leur Bureau consulaire un pli contenant :
- le certificat électoral ( le document certifiant le droit de vote)
- deux bulletins de vote de couleur différente pour chaque référendum :

- Deux enveloppes de formats différents.
c. L'électeur exprimera son suffrage en traçant un signe dans le rectangle du bulletin correspondant à la réponse de son choix (OUI ou NON), en utilisant EXCLUSIVEMENT un stylo à encre noir ou bleu.
d. Les deux bulletins seront introduits dans l'enveloppe entièrement blanche, plus petite, qui devra être refermée et cachetée. Cette enveloppe cachetée, ainsi que le talon du certificat électoral (qui doit être détaché du certificat électoral suivant la ligne pointillée ) devront être introduits dans l'enveloppe plus grande, affranchie, portant l'adresse du Bureau consulaire compétent.
e. Il est recommandé de n'apposer aucun signe de reconnaissance ni sur les bulletins, ni sur l'enveloppe cachetée, ni sur le talon, sous peine d'annulation du suffrage. Aussi bien l'enveloppe cachetée que les bulletins devront être intacts. LE NOM DE L'EXPEDITEUR NE DEVRA PAS FIGURER SUR L'ENVELOPPE AFFRANCHIE A RENVOYER AU BUREAU CONSULAIRE. Cette enveloppe doit être renvoyée par correspondance au Bureau consulaire dans les meilleurs délais et en tout cas avant le 5 juin prochain (dixième jour avant le vote).
f. Les électeurs qui, quatorze jours avant la date du vote (à partir du 1er juin) n'auraient pas reçu chez eux le pli électoral pourront le demander personnellement à leur Bureau consulaire, et obtenir une copie du pli électoral. L'électeur est tenu de renvoyer au plus tôt par courrier au Bureau consulaire l'enveloppe affranchie contenant les bulletins, dans le délai fixé (avant le 5 juin).

REFERENDUM JUNIO 2003

LEY 459 del 27 de Diciembre 2001: "Normas para en ejercicio del derecho de voto de los ciudadanos italianos residentes en el exterior"

¿Para qué se vota?
a. El Próximo 15 de Junio de 2003 se votará para dos referendum populares abrogativos.
b. El primero se refiere a la reintegración de los trabajadores ilegítimamente despedidos - Abrogación de las normas que establecen límites numéricos de exención para la aplicación del artículo 18 del Estatuto de los Trabajadores.
c. El segundo se refiere a la abrogación de la servidumbre obligatoria de tendidos eléctricos de alta tensión (Eliminación de la obligatoriedad del paso de la red de alta tensión para el propietario de un terreno).
¿Quién vota?
a. Por primera vez podrán votar por correspondencia todos los ciudadanos italianos residentes en el exterior inscriptos en las listas electorales.
¿Cómo se vota?
a. El voto de los ciudadanos italianos residentes en el exterior se expresa por correspondencia, según lo establecido por el artículo 1, inciso 2, de la Ley 459/2001.
b. Antes del 28 de Mayo próximo, los electores, que no hayan realizado la opción de votar en Italia, recibirá de la correspondiente Oficina Consular un sobre que contendrá:

>> El certificado electoral (Es decir el documento que certifica su derecho a votar)
>> Dos boletas para la votación de colores distintos, uno para cada referendum:

I° CONSULTA. BOLETA DE COLOR AZUL "REINTEGRACION DE LOS TRABAJADORES ILEGITIMAMENTE DESPEDIDOS. ABROGACION DE LAS NORMAS QUE ESTABLECEN LOS LIMITES NUMERICOS Y LAS EXENCIONES PARA LA APLICACION DEL ARTICULO 18 DEL ESTATUTO DE LOS TRABAJADORES"

II°CONSULTA. BOLETA DE COLOR NARANJA "SERVIDUMBRE OBLIGATORIA PARA TENDIDOS ELECTRICOS DE ALTA TENSION. ABROGACION.

>> Dos sobres de formato distinto.
c. El elector expresa su voto realizando una marca en el rectángulo de la boleta que contiene la respuesta elegida (SI o NO) utilizando EXCLUSIVAMENTE una lapicera que escriba con color negro o azul.
d. Ambas boletas serán depositadas en el sobre más pequeño completametne blanco el mismo deberá cerrarse cuidadosamente. Este sobre perfectamente cerrado y el cupón del certificado electoral (el cuál debe ser separado del certificado utilizando la línea de puntos dispuestas a tal fin) deben ser colocados en el sobre más grande que contiene la respuesta postal paga y la dirección de la Oficina Consular competente.
e. Se recomienda no poner ningún tipo de identificación ni marca de reconocimento sobre las boletas, el sobre cerrado o sobre el cupón del certificado electoral, en cuyo caso el voto será declarado nulo. Tanto el sobre cerrado como las boletas deben estar completas. EN EL SOBRE CON LA RESPUESTA POSTAL PAGA QUE SE DEBE DEVOLVER A LA OFICINA CONSULAR NO SE DEBE INCLUIR EL REMITENTE. Este sobre debe ser devuelto por correo a la Oficina Consular lo más rápido posible antes del 5 de julio próximo (decimo dia anterior a la votación).
f. Los electores que, catorce días antes de la fecha de las eleciones (contando a partir del 1 de Junio), no hayan recibido todavía en su domicilio el sobre electoral pueden requerirlo presentándose personalmente en el Consulado General de Italia en Córdoba y retirar un duplicado del sobre con el material electoral. El elector deberá devolver lo antes posible por correo el sobre con la respuesta postal paga que contiene las boletas dentro del plazo fijado (antes del 5 de Junio).

Gesetz Nr. 459 vom 27. Dezember 2001 über „Bestimmungen
für die Ausübung des Wahlrechts durch die im Auslandwohnhaften italienischen Staatsbürger“

1. Um welche Wahl geht es?
a. Am kommenden 15. Juni wird in zwei Volksentscheiden aufhebenden Charakters abgestimmt.
b. Das erste Referendum betrifft die Wiedereingliederung der rechtswidrig gekündigten Arbeitnehmer - Aufhebung der Bestimmungen, die zahlenmäßige Begrenzungen und Befreiungen festlegen für die Anwendung von Artikel 18 des Arbeitnehmerstatuts.
c. Das zweite Referendum betrifft die Abschaffung des Zwangsservituts für Überlandleitungen (Abschaffung der Verpflichtung für den Grundstückseigentümer, eine Fernleitung über seinen Grund führen zu lassen).

2. Wer wählt?
a. Erstmals können mittels Briefwahl alle im Ausland ansässigen italienischen Bürger wählen, die in den Wählerlisten eingetragen sind.
3. Wie wird gewählt?
a. Die Stimmabgabe der im Ausland lebenden Italiener erfolgt durch Briefwahl, wie vorgesehen in Art. 1, Absatz 2, des Gesetzes Nr. 459/2001.
b. Bis zum 28. Mai wird jeder Wahlberechtigte, sofern er nicht für die Stimmabgabe in Italien optiert hat, von seinem Konsulat einen Umschlag mit folgendem Inhalt erhalten:
- die Wahlkarte (also das Dokument, welches das Wahlrecht bescheinigt);
- zwei Stimmzettel von unterschiedlicher Farbe für jedes Referendum:
I. HELLBLAUER STIMMZETTEL „ Wiedereingliederung der rechtswidrig entlassenen Arbeitnehmer. Aufhebung der Bestimmungen, die zahlenmäßige Begrenzungen und Befreiungen festlegen für die Anwendung von Artikel 18 des Arbeitnehmerstatuts"
II. ORANGEROTER STIMMZETTEL „ Zwangsservitut für Überlandleitungen. Abschaffung"
- zwei Briefumschläge unterschiedlichen Formats.
c. Der Wähler gibt seine Stimme durch Ankreuzen des Rechtecks auf dem Stimmzettel ab, das die bevorzugte Antwort enthält (JA oder NEIN); hierbei darf AUSSCHLIESSLICH ein schwarz oder blau schreibender Kugelschreiber verwendet werden.
d. Beide Stimmzettel werden in den kleineren völlig weißen Umschlag gesteckt, der geschlossen und versiegelt werden muss. Dieser versiegelte Umschlag und der Abschnitt der Wahlkarte (der an der gestrichelten Linie abgetrennt werden muss) werden in den größeren vorfrankierten Umschlag mit der Anschrift des zuständigen Konsulats gelegt.
e. Es wird dringend darauf hingewiesen, weder auf den Stimmzetteln, noch auf dem versiegelten Umschlag, noch auf dem Abschnitt der Wahlkarte keinerlei Erkennungsmerkmal anzubringen, da sonst die Stimme ungültig ist. Sowohl der versiegelte Umschlag als auch die Stimmzettel müssen unversehrt sein. AUF DEM FÜR DAS KONSULAT BESTIMMTEN VORFRANKIERTEN UMSCHLAG WIRD KEIN ABSENDER ANGEGEBEN. Dieser Umschlag ist so bald wie möglich per Post an das Konsulat zurückzusenden, spätestens jedenfalls bis zum 5. Juni 2003 (zehnter Tag vor der Abstimmung).
f. Die Wähler, die vierzehn Tage vor dem Datum der Volksentscheide (d.h. ab dem 1. Juni) den Wahlbrief noch nicht an ihrem Wohnsitz erhalten haben, können ihn durch persönliches Erscheinen bei ihrem Konsulat beantragen und dort ein Duplikat des Wahlbriefs abholen. Der Wähler hat den vorfrankierten Umschlag mit den Stimmzetteln möglichst bald per Post an das Konsulat zurückzuschicken innerhalb der festgesetzten Frist (d.h. nicht später als bis zum 5. Juni).
